Taxacom: RES: Article 23.9 - Reversal of precedence

Note that the nomen oblitum -- nomen protectum clause can only be claimed when the senior name has not been used as valid after 1899.
When Fowler (1934) proposed the new subfamily name Pseudocrenilabrinae, he used the name as valid and it cannot become a nomen oblitum.

Michael: In zoology, we operate with the "Principle of Coordination", which is in force for species-group names, genus-group names and family-group names. For family-group names it runs like this:

--------------------------------------
Article 36.1. Statement of the Principle of Coordination applied to family-group names

A name established for a taxon at any rank in the family group is deemed to have been simultaneously established for nominal taxa at all other ranks in the family group; all these taxa have the same type genus, and their names are formed from the stem of the name of the type genus [Art. 29.3] with appropriate change of suffix [Art. 34.1]. The name has the same authorship and date at every rank.
--------------------------------------

So, when Fowler (1934) proposed the new subfamily name Pseudocrenilabrinae, he is considered to have proposed also family-group names at other ranks within the family group:

Family Pseudocrenilabridae Fowler, 1934
Tribe Pseudocrenilabrini Fowler, 1934
Subtribe Pseudocrenilabrina Fowler, 1934

This means that a new subtribe named Pseudocrenilabrina would be homonymous to an earlier proposed tribal name Pseudocrenilabrini.

Just to make it clear: There is no "new name" here and none should be "proposed". All these names are one and the same and refer to the same family-group name, and the authorship is Fowler (1934). The rule of Reversal of Precedence (Article 23.9) only applies to cases of synonymy. The *nomen
ablitum* remains available and should be used as a valid name whenever the *nomen protectum* is not synonymous, as it is the case of
*Pseudocrenilabrina* (whenever *Haplochromis* is not included in this subtribe). The Example next to Article 23.9.2 demonstrates when a "nomen
oblitum* should be used as a valid name.

Brilliant. Thank you Michael for this precious question. Such requests are very useful because we can provide such cases as Examples for the next Code edition.

Stephen was apparently on the right path. If I have not overlooked something important.

Decisive should be Art. 23.3.1:

"23.3.1. Priority of the name of a nominal taxon is not affected by elevation or reduction in rank of the taxon within the family group, genus group or species group [Arts. 36, 43, 46], nor by any mandatory change in suffix of a family-group name consequent upon change in rank [Art. 34]."

If the action was taken under Art. 23.9.2 then the senior name as such was fixed as not having precedence over the junior name. The term "synonym"
refers to a name, which can be extracted from the Glossary.

GLOSSARY
"synonym, n. Each of two or more names of the same rank used to denote the same taxonomic taxon."

So under Art. 23.9.2 was determined that the senior tribe name should not have precedence over the junior tribe name.
Art. 23.3.1 determines that priority is not affected by reduction of this tribe name in rank to denote a subtribe name.
So the synonymy will also apply to the subtribe situations.

Michael, could you provide your publication for being used as an Example to illustrate this case? Is it open access?

Best wishes
Francisco
