Hi,
What about the following, should it be treated as a name validly published under ICBN 34.1 ???
In his exsiccata (Herbarium Normale) Fries (1847) distributed material on a sheet labelled as ''Hieracium caesionigrescens s. ab H. caesio diversum ut H. nigrescens ab
H. murorum, ligulis primitus ciliatis, sed obsolete. Potissimum cum H.
inciso jungendum.
Norveg. Christianiae Jul. Blytt. H. murorum v. incisum. Blytt!
Christ.''
This is fairly clear and should be regarded as the valid publication of the new species Hieracium caesionigrescens Fr., allthoug the diagnoses tells that it is very similar to H. incisum. However, in the conspectus accompanying the same exsiccata (''printed matter accompanying exsiccata'' sensu ICBN 30.4) Fries indexes this particular sheet in the exsiccata as ''Hieracium *incisum. Hoppe, var.''. Thus, here, in the same publication, Fries treats his ''new species'' as a variety not definitely associated (ICBN 33.1) with any particular species (but with the subspecies incisum Hoppe).
Any opinions?
